Recent Changes in legislation across the UK will affect the collection of empty packaging during the forthcoming year. The introduction of The Waste (England and Wales) Regulations 2011, mirror legislation is enacted in Scotland, makes some basic changes to the handling of waste.
This legislation makes The Hierarchy of Waste a priority order in the management of any, and all, waste streams. Companies should seek to have their waste handled, where possible, according to the following priority.

The legislation also makes changes to the Environmental Protection Act 1990 and specifically the Duty of Care Transfer Note and Hazardous waste transfer notes. It will legally have to change in the next five months. The duty of care will see the consignee having to sign to declare that they have undertaken to comply with the Hierarchy of Waste.
The following is the governments recommended example from the legislation;
“I certify that the information in part A B and C above are correct that the carrier is registered or exempt and was advised of the appropriate precautionary measures. All of the waste is packaged and labelled correctly and the carrier has been advised of any special handling requirements. I confirm that I have fulfilled my duty to apply the waste hierarchy as required by section 34(2B) of the Environmental Protection Act 1990.”
This undertaking will also be implemented on all Transfer notes in some recognised format. We will be changing our transfer notes within the next few months to comply with these changes.
The note will also require your operatives to fill in your company SIC Code as part of the details required.
